I draw attention to:-

the SCA Appeal (see link above) on Friday Nov 3, 2017 by NPA against Oscar Pistorius regarding a too lenient sentence handed down by J Masipa on Friday Nov 3, 2017, in which SCA Judgement was reserved,

and to my application to the Constitutional Court (link above) which set out the SCA's & HC's Gross Errors.

 

It is a gross travesty of Justice that the SCA Court has ignored the Gross Errors by the SCA Justices within the underlying SCA Judgement (96/2015), of which gross errors the Justices had long ago been informed by me, and to which J Masipa believed herself, wrongly so, to be bound by the grossly erroneous SCA Judgement and hence to wronggly re-sentence Pistorius; and to which NPA are now wrongly appealing a too-lenient sentence by J Masipa.

 

Since the NPA are seeking an Appeal on the claimed leniency of re-sentencing, it should & must be a right of Justice that ALL matters of error be considered by the SCA, including the SCA's own previous errors. It would be 'selective Justice' if ALL matters pertaining to an Appeal were not open to scrutiny.

 

It is clear that Pistorius's legal defence team have been grossly negligent in this regard. Their refusal to engage with me on the technical matters of Trial & Appeal can only be construed as intent to maintain Courts as closed-shop.

 

In the circumstances of the gross errors by SCA Justices & HC J Masipa it would be correct that Pistorius's conviction for murder (by SCA) be overturned and the original 'manslaughter' Judgement by J Masipa also be overturned.
